User agreement

This User Agreement (hereinafter referred to as the Agreement) is governed by the norms of the current legislation of Ukraine, including the provisions of the Law of Ukraine “On Electronic Commerce”, the Law of Ukraine “On Consumer Protection”, the Law of Ukraine “On Advertising”, the Law of Ukraine “On Personal Data Protection”, as well as other laws and regulations applicable in Ukraine. Shoco.ua online store on the one hand, and the User on the other hand, undertake to comply with the terms of this Agreement in the process of legal relations

Terms and definitions

Administration shall mean the administration of the shoco.ua online store, accessible at shoco.ua, Individual Entrepreneur Liulich Marta Yuriivna, place of registration: Main Administration of the State Tax Service in Lviv region, Lviv State Tax Inspectorate (Frankivskyi district of Lviv city).

Website (online store) shall mean a website accessible at shoco.ua.

User shall mean a capable person who has agreed to the terms of the Agreement, who has access to the Website via the Internet and uses it.

Subject of the Agreement

1.1. The subject of this Agreement is to provide the User of the Online Store with access to the information, goods and services available on the Website and to regulate the procedure for using the Website by the User.

1.1.1. The Online store provides the User with the following services:

free access to electronic content for personal non-commercial use and with the right to purchase (download) and view content;
access to the search and navigation tools of the online store;
providing the User with the opportunity to post messages, comments, reviews;
free access to information on goods/services and information on the purchase of goods/services;
registration for events;
other types of services implemented on the pages of the Online store.

1.1.2. This Agreement applies to all current (actually functioning) services of the Online Store, as well as any further modifications and additional services of the Online Store that may be introduced in the future.

1.2. Access to the Online store is provided free of charge.

1.3. This Agreement is a public offer. By accessing the Website, the User is deemed to have acceded to this Agreement and agrees to its terms. If the User disagrees with such conditions, they undertake to immediately stop using the Website.

1.4. The use of Website materials and services is stipulated by the current legislation in Ukraine.

User registration, personal data collection and privacy

2.1. By placing an order on the Website, the User agrees to the terms of this Agreement.

2.2. The Online store administration collects, stores and processes information containing the User’s personal data in accordance with the current legislation of Ukraine and the Privacy and Personal Data Protection Policy posted on the Website.

2.3. The User guarantees that they are older than 18 years of age and have full legal capacity.

Rights and Obligations of the Parties

3.1. The Website administration has the right to:

3.1.1. Change the Website terms of use and the content of the Website directly by placing a new version of the Agreement on the Website, which becomes effective as soon as it is published on the Website.

3.1.2. Restrict access to the Website if the User violates the terms of this Agreement.

3.1.3. Delete any message/comment of the User on the Website without their consent and use any messages/comments of the User for free.

3.1.4. In case of detecting inaccurate information provided by the User when registering on the Website, the Administration reserves the unconditional right to cancel such an account without any refund or compensation.

3.2. The User has the right to:

3.2.1. Access the Website after successful registration.

3.2.2. Use all the services available on the Website, as well as purchase goods/services offered on the Website.

3.2.3. Use the Website solely for the purpose and in the manner prescribed by this Agreement and the legislation of Ukraine.

3.3. The User is obliged to:

3.3.1. Provide, at the request of the Website Administration, additional information that is directly related to the services provided on the Website.

3.3.2. Not to violate the property and/or non-property rights of the relevant stakeholders when using the Website.

3.3.3. Not to carry out actions that can be regarded as disrupting the normal operation of the Website.

3.3.4. Not to use the Website for disclosure of any confidential information and information that is protected in accordance with the current legislation of Ukraine.

3.3.5. Not to use the Website to distribute advertising information without the consent of the Website Administration.

3.3.5. Not to use the services of the Online store for:

– uploading illegal content;

– incitement to commit unlawful acts;

– committing unlawful acts (including, but not limited to, violating the rights of third parties, humiliating the rights of minorities, etc.)

– pretending to be another person and/or representative of the organization without sufficient legal grounds.

3.3.6. Provide reliable and accurate information about themselves and their contact details when using the Website (including, but not limited to, registering on the Website, registering for an event, using the services provided on the Website, buying goods, etc.).

3.3.7. Be responsible for maintaining the security and confidentiality of the login and password provided by the Website Administration to the User after registration. The User is responsible for any actions with the website login and password. In case of loss of login and/or password, the User undertakes to notify the website Administration. It is not allowed to give the login and password to third parties. If the transfer of the login and password to third parties is detected, the Administration has the right to cancel such an account and cancel purchases made through such an account.

3.3.8. Before using the Website, read and agree to the Privacy and Personal Data Protection Policy.

The user is not allowed to:

3.4.1. Use any devices, programs, procedures, algorithms and perform other actions to access, acquire, or track the content of the Online store website.

3.4.2. Disrupt the functioning of the Website.

3.4.3. In any way, bypass the navigation system of the Website to obtain/attempt to obtain any information, documents, or materials by any means that are not specifically provided through the services of this Website.

3.4.4. Get unauthorized access to the functions of the website, any other systems or networks related to this Site.

3.4.5. Violate the security or authentication system on the Website or in another network related to the Website.

3.4.5. Perform a reverse search, track or attempt to perform a reverse search, track any information about any other User of the Website.

3.4.7. Use the Website and its content for any purpose prohibited by the current legislation of Ukraine.

Terms of Use of the Online Store Website

4.1. The Website and the content displayed on the Website are owned and managed by the Website Administration.

4.2. The content of the Website shall not be copied, published, transmitted, or distributed in any way without the prior written consent of the Website Administration.

4.3. This Agreement applies to all additional provisions for the purchase of the Goods and the provision of services available for order on the Website.

4.4. The Website Administration has the right at any time without notifying the User to amend the list of services and Goods available for order on the Website, as well as the price.

4.5. Intellectual property rights to information and goods displayed on the Website belong to the Administration. The use of text and/or photo/video materials posted on the Website is possible only with the permission of the Administration.

Liability

5.1. The Website Administration shall under no circumstances be liable for any loss/damage arising from the use of the Website, the inability to use, or the results of using the Website.

5.2. Any losses that the User may incur in case of intentional or unintentional violation of any provision of this Agreement, as well as resulting from unauthorized access to the communications of another User, shall not be reimbursed by the Website Administration.

5.3. The Website administration Shall not be responsible for:

– delays or failures in the course of the operation caused by force majeure, or malfunctions in telecommunication, computer, electrical or other systems;

– work of transfer systems, banks, payment systems, and delays that have arisen in connection with their work;

– Website malfunctioning in case the User does not have the necessary technical means to use it;

– illegal actions of third parties;

– failures in the operation of the Website caused by computer viruses or errors in the code.

5.4. The materials and services of the Website are presented and provided without any guarantees. The Online store does not guarantee the completeness and accuracy of such materials and/or services.
